Court Rules Against President Obama's Illegal Executive Amnesty

On Tuesday, May 26, the US 5th Circuit Court of Appeals upheld the injunction against President Obama's illegal executive amnesty. The injunction was issued by a federal district court earlier this year and required the Administration to cease all implementation of the November 2014 Executive Actions. Texas is leading the lawsuit with 25 other states against the Administration.

On Tuesday, May 26, the US 5th Circuit Court of Appeals upheld the injunction against President Obama’s illegal executive amnesty.  The injunction was issued by a federal district court earlier this year and required the Administration to cease all implementation of the November 2014 Executive Actions.  Texas is leading the lawsuit with 25 other states against the Administration.

“I’m extremely proud of Texas for leading the charge against these unlawful policies.  Tuesday’s ruling was a big win and recognition by the courts of what Texans have known for years: refusing to enforce our Nation’s immigration laws harms Texas and the American people.”

Carter and over 100 other Members of Congress filed an amicus brief earlier this month urging the appeals court to support the district court’s decision to block the amnesty.  Tuesday’s decision halts further implementation of the executive actions, and hints to a favorable decision in the future.  “In their decision the 5th Circuit Court of Appeals indicated Texas would suffer irreparable harm should the President’s lawless policies continue and that the Administration was not likely to succeed on the merits of their case; simply put, wrong is wrong.  Maybe now the President will finally get the message that he must work with Congress to find real solutions to difficult problems and stop hiding behind his pen and his phone.” 

Rep. Carter represents Texas District 31, which includes Fort Hood, the largest military installation in the free world. He serves as Chairman of the Homeland Security Subcommittee on Appropriations, is on the Subcommittee for Commerce, Justice and Science and the Defense Subcommittee.
